In 2018, California Penal Code sections 851.91 and 851.92 were enacted to allow certain people to petition the courts to seal their arrest records. These new laws apply to the following people:

 


  • Those who were arrested for a law violation but were never charged with a crime; or
  • Those who were arrested and subsequently charged, but never convicted, because the case was dismissed, or they were acquitted at trial.
