In 2018, California Penal Code sections 851.91 and 851.92 were enacted to allow certain people to petition the courts to seal their arrest records. These new laws apply to the following people:

  • Those who were arrested for a law violation but were never charged with a crime; or
  • Those who were arrested and subsequently charged, but never convicted, because the case was dismissed, or they were acquitted at trial.

Background checks sometimes show arrest information and case information, even if a case was dismissed or charges were never brought. These new laws allow for people to have a court seal this information to keep their records looking clean.
